All prices displayed are in Croatian Kuna (HRK) or Euro (EUR) unless otherwise stated. Prices do not include taxes, registration fees, documentation fees, or other applicable charges unless explicitly stated. Payment terms will be provided during the transaction process.

4.3 Vehicle Inspection

We encourage all potential buyers to inspect vehicles in person or arrange for professional inspection before purchase. Vehicle conditions may vary from descriptions or photographs. All sales are final unless otherwise agreed in writing.

5. Prohibited Uses

7. User-Generated Content

9.2 Maximum Liability

Our total liability to you for all claims arising from or related to the Site shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.

14.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

14.2 Jurisdiction

Any disputes arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Croatia. You consent to personal jurisdiction in such courts and waive any objection to venue.

15. Dispute Resolution

15.1 Informal Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute informally by contacting us directly. We will attempt to resolve disputes in good faith.

15.2 Arbitration

If informal resolution is unsuccessful within 30 days, disputes may be resolved through binding arbitration in accordance with Croatian arbitration rules. Each party shall bear its own costs of arbitration unless otherwise awarded by the arbitrator.

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions or representative proceedings.

16. Miscellaneous Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gearshift Auto Gallery regarding the use of the Site and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms may be translated into other languages for convenience. In the event of conflict, the English version shall prevail.
